Terms of Use
These Terms of Use (hereinafter "ToU") govern access to and use of the Fantasya IRC chat network and the associated website (hereinafter "the Service"). By accessing the Service, you unreservedly accept these ToU. If you do not accept these conditions, you must refrain from using the Service.
📋 Article 1 — Service publisher
The Fantasya network is published and administered by private individuals (natural persons), hereinafter referred to as "the Administrator", whose contact details can be obtained via the contact form available on the website.
The Service is hosted on third-party infrastructure. The host's contact details are available in the legal notices.
Single point of contact (Digital Services Act): In accordance with Articles 11 and 12 of the Digital Services Act, the Administrator designates the website's contact form (or the associated email address) as the single point of contact for authorities of the Member States, the European Commission, the European Board for Digital Services, and users. Communications must be drafted in French.
🔍 Article 2 — Description of the Service
Fantasya is a community chat network based on the IRC (Internet Relay Chat) protocol. It allows users to communicate in real time in public or private themed channels.
The Service can be accessed in two ways:
- Open access: connection without prior registration, using a freely chosen, unregistered nickname.
- Registered account access: registration of the nickname with the network services (NickServ), allowing you to reserve and protect your identifier.
👤 Article 3 — Access to the Service and age requirements
In accordance with applicable French and European law, in particular Regulation (EU) 2022/2065 (DSA) and French law on the protection of minors online, access to the Service is subject to the following age requirements:
- The Service is available to persons aged at least 15.
- Some channels cover topics intended for a mature audience strictly aged 18+. Access is restricted by technical means as far as the IRC protocol allows. However, without age verification by a trusted third party, sharing explicitly pornographic media or extreme violence there remains strictly prohibited, under penalty of a ban. Any attempt by a minor to access these spaces is prohibited.
- The Administrator reserves the right to request proof of age and to suspend or delete any account where the user is suspected of failing to meet these requirements.
📝 Article 4 — Registering a nickname
Registering a nickname (via NickServ or any equivalent system) is optional but recommended to reserve your identity on the network. By registering, the user undertakes to:
- Provide a valid, up-to-date email address.
- Not impersonate others.
- Keep their password confidential.
- Notify the Administrator immediately in case of unauthorized use of their account.
The Administrator cannot be held liable for damage resulting from the user's failure to meet these obligations.
⚖️ Article 5 — Rules of conduct
Every user undertakes to use the Service in compliance with applicable law and these ToU. The following rules apply across the entire Fantasya network and bind every user, whether connected with open access or via a registered account.
🚫 5.1 — Prohibited content and statements
- 🗣️ Insults, vulgar, defamatory, fascist, or racist remarks
- 😤 Any form of harassment toward a user, an IRCop, or a team member
- 🛒 Offering, selling, buying, or exchanging illicit goods or services: including but not limited to drugs, weapons, forged identity documents, stolen banking or personal data (logs, combos, card numbers), malware, as well as procuring and escorting services.
- 🔞 Sharing extremely violent or pornographic content in public spaces: sharing gore images, terrorist propaganda, child sexual abuse material (which will be reported immediately), or any pornographic content outside strictly restricted and labelled spaces.
- 🔏 Publishing personal contact details on public channels (postal address, phone number, etc.) — a practice known as doxing
- 📢 Abusive use of capital letters on public channels (by IRC convention, capitals mean you are shouting)
- 🔁 Flooding: abusive repetition of characters, words, or messages on public channels — tolerated in private channels, strictly forbidden on public channels
- 🏷️ Offensive, insulting, or discriminatory channel names, channel topics, and nicknames
- 📣 SPAM: any unsolicited advertisement or message
- 📡 Advertising for other IRC networks or competing services
- 🏴☠️ Piracy and exchanging protected data to which the user has no rights (software, music files, audiovisual works, etc.)
- ⚖️ Any content or behaviour prohibited by the laws of the countries hosting Fantasya servers
🔧 5.2 — Prohibited technical behaviour
- 🚧 Circumventing any technical sanction, including: ban, akill, gline, sgline, sqline, kline, zline, silence, or ignore
- 🌐 Connecting via a public proxy: SOCKS, HTTP proxy, public bouncer, or any unauthenticated relay
- 👥 Multiple connections (clones) beyond 3 simultaneous connections per person
- 🎭 Any impersonation of an IRCop or another user
- 🏴☠️ Illegal takeover of a channel
- ⚠️ Abusive use of network services, in particular appropriating channels or registered nicknames belonging to others
- 💥 Mass sending of malicious data (nuke), exploiting bugs, or any hacking attempt targeting servers, users, IRCops, or network services
🤖 5.3 — Bots
Bots are tolerated on all network servers unless explicitly prohibited locally. They are subject to the same rules of conduct as human users and must comply in full with these ToU.
📌 5.4 — Local rules
Additional rules may apply on each server or official channel of the network. These local rules supplement these ToU and do not replace them. In case of conflict, these ToU prevail.
The Administrator and the moderation team reserve the right to remove any content, or to kick or ban any user who breaches these rules, without prior notice or obligation to justify the decision.
🛡️ Article 6 — Moderation and sanctions
The Service has a volunteer moderation team responsible for enforcing these ToU and the network's internal rules. In case of a breach, the following sanctions may be applied, depending on severity:
- Warning
- Temporary silence (mute)
- Channel kick
- Temporary ban
- Permanent ban
- Reporting to the authorities
Serious offences (illegal content, child sexual abuse material, credible threats) will be reported immediately to the competent authorities, including via the PHAROS platform.
Reasons for decisions and appeals (DSA): When a restrictive measure is taken (ban, removal of content hosted by the Service), the Administrator or moderation team will endeavour to provide the affected user with a clear and specific explanation of the reasons (generally included in the IRC kick/ban message). The user may challenge the decision by contacting the team via the #pole-moderation channel or the website's contact form.
Combatting abuse: After a prior warning, the Administrator reserves the right to temporarily or permanently suspend the account or network access of any user who frequently posts manifestly illegal content, or who frequently submits manifestly unfounded reports or complaints.
🔒 Article 7 — Personal data and privacy
In accordance with the General Data Protection Regulation (GDPR — EU Regulation 2016/679) and French data protection law, the Administrator undertakes to handle users' personal data with the utmost care.
Data that may be collected includes:
- Connection IP address (for security and moderation)
- Email address provided when registering a nickname
- Connection logs (nickname, timestamp, IP address)
This data is never sold to third parties. It is kept only for as long as necessary for the purposes for which it was collected, and at most in line with applicable legal retention periods.
Under the GDPR, you have the right of access, rectification, erasure, restriction, and portability of your data, as well as the right to object. To exercise these rights, contact the Administrator via the website's contact form.

💬 Article 8 — Administrator's liability
The Service is provided "as is". The Administrator, acting as a private individual, strives to ensure availability and security of the Service but cannot guarantee uninterrupted availability.
The Administrator cannot be held liable for:
- Statements exchanged between users on the chat network
- Content posted by users in channels
- Service interruptions due to external causes (network outages, hosting provider, etc.)
- Damage resulting from fraudulent use or use that does not comply with these ToU
As a hosting provider within the meaning of French law on confidence in the digital economy (LCEN), the Administrator is not subject to a general obligation to monitor content in advance.
Furthermore, due to the decentralised nature of the IRC protocol, the Administrator does not have the technical ability to retroactively erase text messages already delivered to users' client software.
However, for any media, file, or image hosted on the Service's infrastructure (URL generation), the Administrator undertakes to act promptly to remove them and make them inaccessible upon notification of manifestly illegal content, and will cooperate fully with the judicial authorities in case of serious offences.
📣 Article 9 — Reporting
Any user may report illegal content or behaviour contrary to these ToU via:
- The website's contact form
- Official help channels on the network: #pole-moderation (for the moderation team) and #fr-opers (for administrators)
- Directly in channel or in private using the user-reporting feature
- Directly in channel by addressing a moderator
The Administrator undertakes to handle every report as promptly as possible.
Users are particularly encouraged to use these tools without delay to report to the moderation team any attempt to use the network for illicit transactions (drug sales, stolen data, etc.) or any distribution of child sexual abuse or terrorist content.
DSA compliance (notification mechanism): For a report submitted via the form or by email to be handled effectively under the law, the user is invited to provide:
- A clear explanation of why the content is considered illegal.
- The exact location of the content (e.g. channel name and time, nickname, or exact image URL).
- A statement confirming that the report is made in good faith and that the information is accurate.
✏️ Article 10 — Changes to the ToU
The Administrator reserves the right to amend these ToU at any time. Users will be informed of any material change by an announcement on the website or the network. Continued use of the Service after a change constitutes acceptance of the new ToU.
🏛️ Article 11 — Applicable law and jurisdiction
These ToU are governed by French law. In case of dispute, and failing an amicable settlement, the competent French courts shall have exclusive jurisdiction.
